Terms of Service
These Terms govern access to Elite Avatars websites, applications, business technology services and AI-enabled products, including EAV Email Command.
1. Agreement
By accessing or using an Elite Avatars service that links to these Terms, you agree to these Terms and the applicable Privacy Policy. If you use a service on behalf of an organization, you represent that you are authorized to bind or act for that organization.
2. Services
Elite Avatars provides business technology, AI-assisted software, digital products, automation services and related professional services. Product features may change as services develop, and some features may be identified as beta, preview or limited availability.
3. EAV Email Command
EAV Email Command may connect authorized mailboxes, receive and organize email, maintain conversation context, classify messages, prepare AI-assisted drafts, manage campaigns and contacts, and send authorized email through supported providers.
Unless an organization deliberately enables an approved automated mode, Email Command may operate in Draft Only mode so that sending requires human approval. Users are responsible for reviewing important drafts and for the communications they approve or authorize.
4. Google OAuth and Gmail
When you connect Gmail, you authorize Email Command to use the Google permissions shown on Google's consent screen for the features you request. You must only connect accounts you are authorized to use.
Google services remain subject to Google's own terms, policies and account controls. You may revoke access at any time through your Google Account connected-app settings. Revoking access may disable features that depend on Gmail authorization.
5. Email and messaging responsibilities
You are responsible for the recipients, content, timing and legal basis of messages sent through your account. You may not use Elite Avatars services for unlawful spam, phishing, deception, harassment, impersonation, malware distribution, unauthorized bulk messaging, or communications that violate applicable law or provider policies.
You must honor applicable unsubscribe, suppression, consent and do-not-contact requirements. You are responsible for maintaining accurate sender identity and business information.
6. AI-assisted content
AI output is generated from available instructions and context and may be incomplete, inaccurate or unsuitable for a particular purpose. You should review important communications, especially legal, financial, contractual, refund, complaint, employment, health, safety or other sensitive matters.
Elite Avatars does not guarantee that an AI-generated draft is correct, complete or legally compliant.
7. Accounts and security
You are responsible for protecting your account credentials, devices and connected services and for promptly notifying Elite Avatars of suspected unauthorized use. You may not attempt to bypass security controls, access another tenant's information, probe systems without authorization, or interfere with service operation.
8. Connected services
Third-party integrations, including Google, Gmail, hosting, database, AI, payment or communications providers, may be necessary for certain features. Elite Avatars is not responsible for third-party outages, account restrictions, policy changes or service decisions outside our control.
9. Data, privacy and deletion
Our handling of personal information, Google OAuth data, Gmail data, retention, deletion and revocation is described in the Elite Avatars Privacy Policy. You remain responsible for having the rights and permissions necessary to provide or process information through the service.
10. Intellectual property
Elite Avatars retains rights in its software, designs, trademarks, documentation and service technology. You retain rights in content you lawfully provide, subject to the permissions necessary for Elite Avatars and its service providers to process that content to deliver the requested service.
11. Availability and changes
We work to provide reliable services but do not guarantee uninterrupted or error-free operation. We may maintain, update, limit, suspend or discontinue features where reasonably necessary for security, compliance, provider changes, abuse prevention or product development.
12. Fees and paid services
Paid plans, subscriptions, usage limits, implementation fees or professional services may be governed by the pricing, order, proposal or subscription terms presented at purchase. Unless otherwise stated in writing, fees already earned for completed work are non-refundable.
13. Suspension and termination
We may restrict or suspend access when reasonably necessary to address nonpayment, security risk, abuse, unlawful activity, provider-policy violations or material breaches of these Terms. You may stop using the service at any time and may request account or data deletion as described in the Privacy Policy.
14. Disclaimers
To the extent permitted by law, Elite Avatars services are provided on an "as available" basis without warranties that every feature will meet every business, legal, technical or regulatory requirement. You are responsible for determining whether a service is appropriate for your use case.
15. Limitation of liability
To the extent permitted by applicable law, Elite Avatars will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost opportunities, loss of goodwill, or losses caused by third-party services, unauthorized account access, user-approved content, or failure to follow required review and security practices.
16. Changes to these Terms
We may update these Terms as our services, integrations or legal obligations change. Material revisions will be reflected by an updated effective date on this page.
